These Terms of Service ("Terms") govern your access to and use of AccessiScan, a service provided by GenueLabs ("we", "us", or "our").

1. Acceptance of Terms

By accessing or using AccessiScan, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use our service.

If you are using AccessiScan on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

AccessiScan provides automated website accessibility testing and monitoring services. Our service:

  • Scans websites for accessibility issues based on standards such as WCAG 2.1, ADA, Section 508, and EAA
  • Provides reports identifying potential accessibility barriers
  • Offers monitoring services to track accessibility over time
  • Provides recommendations for fixing identified issues

Important Note: Geo-Targeting and Regional Content

If your website uses geo-targeting (showing different content based on visitor location), please be aware that:

  • Our scanning servers are located in a specific geographic region
  • Scan results will reflect the content served to visitors from that region
  • Results may differ from what you see when viewing your site from a different location

Recommendation: For the most accurate accessibility testing, we recommend temporarily disabling geo-targeting features on your website before running a scan. Once testing is complete and any issues have been addressed, you can re-enable geo-targeting. This ensures that all regional variations of your content are tested consistently.

3. Automated Testing and Professional Audits

AccessiScan provides effective, thorough automated accessibility scanning that identifies a wide range of real issues across your website — from missing alternative text and insufficient contrast to broken ARIA attributes, keyboard traps, and structural problems. Our technology covers the broadest possible range of automatically detectable issues across all major standards (WCAG 2.1, WCAG 2.2, ADA, Section 508, EAA, EN 301 549) and is continuously improved.

At the same time, it is important to understand the distinction between automated scanning and a professional accessibility audit:

  • What our service does. AccessiScan automatically detects technical accessibility violations that can be identified through algorithmic analysis of page structure, styles, and semantics. For the majority of websites, this covers the most common and impactful accessibility issues.
  • What requires human expertise. A small subset of accessibility criteria — such as evaluating the meaningfulness of alternative text, assessing cognitive complexity, or verifying that content makes sense in a particular context — can only be fully assessed by a trained specialist reviewing the site manually. This is inherent to the nature of accessibility standards, not a limitation of any particular tool.
  • Professional audit services. For organizations that require a comprehensive manual accessibility audit (for example, for legal compliance certification or regulatory purposes), GenueLabs offers professional audit services as a separate engagement. These audits are conducted by accessibility specialists and include expert evaluation, detailed compliance reports, and remediation guidance. This is a fundamentally different process from automated scanning in both scope and nature.

Our scan results and recommendations are provided for informational purposes and represent genuine, actionable findings. However, they do not constitute legal advice and should not be used as the sole basis for legal compliance claims. For legal compliance assurance, we recommend combining automated scanning with professional audit where required by your jurisdiction or industry.

4. User Accounts

To access certain features, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Free and Paid Services

Free Scans: We offer limited free scans with restrictions on the number of scans per day and features available. Free scans are subject to change or discontinuation at any time.

Paid Subscriptions: Paid plans provide additional features and increased limits. Subscriptions are billed monthly or annually as selected at purchase. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

6. Acceptable Use

You agree to use AccessiScan only for lawful purposes. You must not:

  • Use the service to scan websites you do not own or have explicit permission to scan
  • Attempt to circumvent rate limits or other restrictions
  • Use the service to perform denial-of-service attacks or overwhelm target websites
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with other users' access to the service
  • Use automated tools beyond those provided by our API
  • Resell or redistribute our service without authorization
  • Use the service for any illegal or harmful purpose

7. Payment Terms

For paid subscriptions:

  • All fees are exclusive of taxes unless otherwise stated
  • Payments are non-refundable except as required by law or as stated in our refund policy
  • We offer a 14-day money-back guarantee for first-time subscribers
  • Price changes will be notified 30 days in advance
  • Failed payments may result in service suspension

8. Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • You will retain access until the end of your current billing period
  • No refunds will be issued for partial months (except under our 14-day guarantee)
  • Your data will be retained for 30 days after cancellation, then deleted

9. Intellectual Property

AccessiScan, including its software, website, logo, and content, is owned by GenueLabs and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any content you submit. By using our service, you grant us a limited license to process your submitted URLs for the purpose of providing our service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
  • ACCURACY OR COMPLETENESS OF SCAN RESULTS
  • UNINTERRUPTED OR ERROR-FREE SERVICE
  • COMPLIANCE WITH ANY SPECIFIC ACCESSIBILITY STANDARD

Our scan results should be used as guidance only. We do not guarantee that following our recommendations will ensure compliance with ADA, WCAG, EAA, or any other accessibility law or standard.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GENUELABS SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES
  • COSTS OF PROCUREMENT OF SUBSTITUTE SERVICES
  • ANY DAMAGES ARISING FROM YOUR USE OF THE SERVICE

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless GenueLabs and its employees, officers, and agents from any claims, damages, or expenses arising from:

  • Your use of the service
  • Your violation of these Terms
  • Your violation of any third-party rights

13. Termination

We may suspend or terminate your access to AccessiScan at any time, with or without cause or notice, including for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of fees
  • Extended periods of inactivity

Upon termination, your right to use the service ceases immediately.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which GenueLabs is incorporated, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting a notice on our website
  • Sending an email to your registered address

Your continued use of AccessiScan after such changes constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
